MR. PAUL GOODSON: I come to personal injury cases as someone who used to be a defense lawyer for the insurance companies. The reality is the plaintiff focused on what's fair. It's the insurance company that's fighting over money. They'll bring up prior health conditions which may or may not have anything to do with your injuries and the accident. Often they have insurance adjusters who will pretend like they're your friend or pretend like they're helping you or pretend like they are representing your interests against the insurance company. Be very cautious, and I wouldn't believe that because at the end of the day, these adjusters work for the insurance company, not you. The first thing I would do is look very specifically at the facts of your case. And what I'm looking for there is factors that the insurance company is going to be afraid of. In other words, it's going to translate into a better settlement for you. But, I'm also going to be looking at factors that they area going to try to bring up that they think we should be afraid of. It may be something that is never going to be admissible in court. And ultimately, if it's not admissible in court and a jury is never going to hear about it, it has no bearing on what your case is worth. Without a lawyer you're not going to know that. The best approach is to be realistic about what helps your case, what doesn't help your case, and what that means in terms of your case's value. So, ultimately, the best approach is to be completely honest with your client about from the beginning of the case. The pluses and minuses are going to come out, and there's not glossing them over. There's no promising things that aren't based in reality.
